Software License

This agreement describes your rights to use BoulderLink software. It supplements our Terms of Service.

1. Agreement

This End-User License Agreement ("License") is between you and TMZ Software ("Licensor") for the BoulderLink whitelabel platform software, including partner-branded mobile apps for iOS and Android and BoulderLink web apps (the "Software"). This License applies to all clients and partners distributing or using a BoulderLink-powered app, regardless of the brand name or logo shown to end users. By installing or using the Software, you agree to this License and our Terms of Service.

2. License grant

Subject to your compliance with this License and the Terms of Service, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Software on devices you own or control, solely for your personal, non-commercial climbing and fitness logging purposes — or, if you are a gym partner, for authorized gym management features under your partnership agreement.

3. Restrictions

Unless expressly permitted by law or by us in writing, you may not:

  • Copy, modify, adapt, or create derivative works of the Software
  • Reverse engineer, decompile, or disassemble the Software, except where prohibited by applicable law
  • Rent, lease, lend, sell, sublicense, or distribute the Software
  • Remove or alter any proprietary notices, labels, or branding
  • Use the Software to build a competing product or service
  • Circumvent technical measures that control access to the Software or its features, including content moderation, upload quarantine, or strike enforcement

4. Ownership

The Software is licensed, not sold. TMZ Software and its licensors retain all right, title, and interest in the Software, including all copyrights, trademarks, trade secrets, and other intellectual property rights. No rights are granted except as expressly stated in this License.

5. Updates and changes

We may provide updates, patches, or new versions of the Software. Some updates may be required to continue using certain features. We may modify or discontinue features at any time. This License applies to updates unless they come with separate terms.

6. Open-source and third-party components

The Software may include open-source libraries and third-party components, each subject to its own license terms. Where those licenses grant you rights that conflict with this License, the open-source terms apply to the relevant component only. A list of third-party notices is available on request at contact@tmz-software.com.

7. Data and content

Your climbing data, media, and account information are handled as described in our Privacy Policy. You are responsible for backing up any content you wish to preserve outside of BoulderLink.

Any content you upload or submit through the Software is subject to automated and manual moderation as described in our Terms of Service. BoulderLink uses third-party services, including Hive (The Hive.ai), to screen images, video, and text for policy violations across all whitelabel apps and partner deployments. Content may be held for review, rejected, or removed if it does not meet our community standards.

8. Termination

This License is effective until terminated. It terminates automatically if you breach any term of this License or the Terms of Service. Upon termination, you must stop using the Software and delete all copies from your devices. Sections that by their nature should survive termination will remain in effect.

9. Disclaimer of warranties

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TMZ SOFTWARE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SOFTWARE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SOFTWARE IS LIMITED AS DESCRIBED IN OUR Terms of Service.

11. Export compliance

You agree to comply with all applicable export control and sanctions laws. You may not use or export the Software in violation of those laws.

12. Apple App Store (iOS)

If you downloaded BoulderLink from the Apple App Store, you acknowledge that this License is between you and TMZ Software only — not Apple. Apple has no obligation to provide maintenance or support for the Software. In the event of any failure of the Software to conform to an applicable warranty, you may notify Apple for a refund of the purchase price (if any). Apple is a third-party beneficiary of this License and may enforce it against you.

13. Google Play (Android)

If you downloaded BoulderLink from Google Play, you acknowledge that Google is not responsible for the Software or its content. Google is a third-party beneficiary where required by Google Play policies.

14. Changes to this License

We may update this License from time to time. We will post changes on this page and update the "Last updated" date above. Your continued use of the Software after changes take effect constitutes acceptance of the updated License.
