1. Agreement
These Terms of Service ("Terms") govern your access to and use of BoulderLink — the whitelabel climbing platform operated by TMZ Software ("we," "our," or "us"), including our mobile apps, web apps, partner-branded experiences, and website (collectively, the "Service"). These Terms apply to all climbers, gyms, clients, and partners using any BoulderLink-powered app, regardless of branding. By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use BoulderLink.
2. Eligibility
You must be at least 13 years old to use BoulderLink. If you are under 18, you represent that you have permission from a parent or guardian. You must provide accurate account information and keep it up to date.
3. The Service
BoulderLink helps climbers browse gym topos, log sends and projects, join challenges and crews, share clips, and connect with their climbing community. Gym partners may use BoulderLink tools to manage routes, resets, and competitions. Features may vary by gym, platform, and subscription plan.
4. Your account
You are responsible for maintaining the security of your account credentials and for all activity under your account. Notify us immediately at contact@tmz-software.com if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms.
5. User content
You may upload or share content such as climbing logs, photos, videos, messages, and profile information ("User Content"). You retain ownership of your User Content. By posting it on BoulderLink, you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, and distribute your User Content solely to operate and improve the Service — including showing it to your crew, gym community, or on leaderboards as your privacy settings allow.
You represent that you own or have the rights to share your User Content and that it does not violate anyone else's rights or applicable law. User Content is subject to our content moderation practices described below and may be delayed, rejected, or removed if it violates our policies.
6. Content moderation
BoulderLink uses automated and manual moderation to keep the platform safe for all climbers, gyms, clients, and partner brands. These rules apply across every whitelabel app on the platform.
We may moderate User Content including, without limitation:
- Photos and images (profile pictures, route photos, competition covers, and other uploads)
- Video clips and related thumbnails
- Text you submit (names, bios, route and challenge details, send notes, messages, and similar fields)
We use Hive (The Hive.ai) visual and text moderation services to automatically screen content for policy violations such as sexual content, violence, hate speech, spam, and other harmful material. Uploads may be placed in quarantine until checks complete; clips may show as "in review" before they are visible to others.
If content violates our policies, we may:
- Reject the upload or prevent it from being published
- Issue a warning or record a strike on your account
- Temporarily or permanently restrict uploads and posting
- Remove content that is already published
- Suspend or terminate your account for serious or repeated violations
Some flagged categories may result in a warning only and not count toward a strike, at our discretion. Our team and authorized gym administrators may also review reported or flagged content manually. Automated moderation is not perfect — we do not guarantee that all violating content will be caught before publication, but we reserve the right to act on content at any time.
7. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or to harass, threaten, or harm others
- Upload content that is hateful, sexually explicit, fraudulent, or infringes intellectual property rights
- Impersonate another person or misrepresent your affiliation with a gym or organization
- Attempt to gain unauthorized access to our systems, other accounts, or gym data
- Scrape, reverse engineer, or interfere with the Service's normal operation
- Use automated means to create accounts or send messages without our permission
We may remove content or restrict accounts that violate these rules or that we reasonably believe pose a safety risk to our community.
8. Gym partnerships
If your gym uses BoulderLink, additional terms may apply between your gym and TMZ Software. Gym-specific challenges, check-in features, and member data sharing are governed by your gym's policies as well as these Terms. We are not responsible for gym operations, route setting, or facility safety.
9. Subscriptions and payments
BoulderLink offers free and paid plans (such as Pro). Paid subscriptions are billed through the Apple App Store, Google Play, or other authorized payment providers. Prices, billing cycles, and features are shown at the time of purchase.
- Subscriptions renew automatically unless cancelled before the renewal date
- Refunds are handled according to the policies of the platform where you purchased
- We may change pricing or plan features with reasonable notice where required by law
10. Intellectual property
BoulderLink, including its design, software, logos, and branding, is owned by TMZ Software and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks without written permission. See our Software License for app usage rights.
11. Third-party services
The Service may integrate with third-party providers for hosting, analytics, chat, push notifications, media delivery, and content moderation (including Hive). Your use of those services may be subject to their own terms and privacy policies. See our Privacy Policy for how we share data with moderation providers.
12. Disclaimers
Climbing is inherently dangerous. BoulderLink is a logging and social tool — it does not replace proper training, supervision, or gym safety protocols. Route grades, topos, and beta may be inaccurate or outdated. Use the Service at your own risk.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TMZ SOFTWARE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) FIFTY US DOLLARS (USD $50).
14. Indemnification
You agree to indemnify and hold harmless TMZ Software from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.
15. Termination
You may stop using BoulderLink and delete your account at any time through the app settings or by contacting support. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination will remain in effect.
16. Changes to these Terms
We may update these Terms from time to time. We will post changes on this page and update the "Last updated" date above. Material changes may be communicated through the app or by email. Continued use after changes take effect means you accept the updated Terms.
17. Governing law
These Terms are governed by the laws of Romania, without regard to conflict-of-law principles. Disputes will be resolved in the courts of Bucharest, Romania, unless mandatory consumer protection laws in your country require otherwise.
